The encroachment at the abutter property remains in place despite multiple occupied units already built under prior approvals. Board discussion highlighted flooding complaints from 12 Plain St and risks of the site acting as a water sponge.

The vote to continue was unanimous, but the chair noted a split on whether to tie the sixth unit to enforcement. Applicant must now return May 12 with a concrete mitigation or removal plan and updates on town and abutter talks. https://meetingwatch.org/nh/salem/planning-board/2026-04-14/

Longer-form draft.
At its April 14, 2026 meeting, the Salem Planning Board continued the public hearing on a sixth detached rental unit at the Willows Park site on 9 Hampshire Street. The decision followed extended discussion of an unresolved 2023 condition requiring removal of a wetland encroachment on the neighboring property at 5 Hampshire Street.

Board members expressed frustration that the encroachment has remained in place for three years while other units were occupied. Neighbor Steve Goulet from 12 Plain Street raised ongoing flooding concerns tied to water flow from Pond Street. The board rejected conditional approval for the new unit and instead directed the applicant to work with staff on a mitigation plan or legal steps for removal before returning on May 12.

All other items on the agenda, including digital sign permits and a lot line adjustment, passed without issue. https://meetingwatch.org/nh/salem/planning-board/2026-04-14/ #MeetingWatch #SalemNH
